Near Miss of the Day 426: Driver squeezes cyclist into kerb - but no action taken by police
The latest video in our Near Miss of the Day series shows the moment a driver squezed a cyclist into the kerb - but no action was taken by the police against the motorist.
Dave, the cyclist involved, told us: "Another poor decision from Northamptonshire Police.
"The footage shows the car overtaking me on my commute home back in November 2019.
"The reply dated 30th April 2020 states: 'during the investigation it was established that despite a collision occurring it transpired no damage or injury in view of this the criteria was not met, in relation to the inconsiderate driving there is a legal requirement to send a NIP within 14 days. The incident was reported on 27/11/19 and allocated to a case builder on 24/12/19 therefore the Statutory limit had passed, so no further action will be taken'.
"It seems that the 27 days taken to allocate an officer has meant that no action can be taken. Something seems wrong with this," he added.

Different force, but mine has a similar approach - they have been great at acting on non-collision near misses, but the only report I've made they didn't act on was a collision with no damage or injury. Makes no sense.

This does not surprise me with Northants Police, they are certainly not cyclists friendly in terms of dealing with any incident involving a cyclist, close pass or even a RTA.
Having had several conversations with the northants police safety unit and submitted several high speed close passes, I can honestly say that they don't give a rats arse about cyclists.
"Please only report anything like this if you have been killed. Then we'll sit on the evidence for too long so we can use that as an excuse for not doing our actual job."
Dangerous driving, likely to have injured a less skilled cyclist. Perhaps this police force needs the benefits of crime prevention explaning to them?

You need to speak to a solicitor if you want to pursue. Because these are the exceptions, accident/collision being one
Do the police always have to give a Notice of Intended Prosecution?
There are some exceptions to the rule that a notice must be served within 14 days of an alleged offence.
Under s2 (1) Road Traffic Offenders Act 1988, if an accident has occurred this dispenses with the need to serve a notice of intended prosecution as the accident itself is deemed to put the driver on notice that they could be prosecuted.
Under s2 (3) Road Traffic Offenders Act 1988, an exception to the requirement to serve a notice of intended prosecution may apply if the police are unable to trace the registered keeper of the vehicle within sufficient time to serve it within 14 days. For example, if there is no record of the registered keeper on the DVLA database it may not be possible for the police to send the letter out in time
I'd be kicking their wing mirror off, as a minimum gesture of my appreciation of their driving skills.

It seems that cyclists’ footage does seem to ‘get lost in the post’ a bit too often. It’s almost like they don’t care
